Litigation, Advocacy and Dispute Resolution

Experienced litigators in our own right, we also partner as co-counsel with the country’s top litigators. We deliver specialized insight and strategy in high stakes matters, which are common in the pension, benefits and executive compensation arena.

We litigate for employers and plan administrators in all forums, including trial and appeals courts, at arbitration, and before the Financial Services Tribunal and other administrative bodies.  Click here for a list representative advocacy work featuring BMKP lawyers.

We have defended pension plan administrators in pension-related human rights discrimination claims before the Ontario and Canadian Human Rights Tribunal where it was alleged that plan provisions discriminated on the basis of gender, disability and marital status. Our success rate in defending these claims has been very high.

Our lawyers have acted as counsel in civil pension negligent misrepresentation, pension loss and pension-related matrimonial litigation, in a variety of class actions, in civil and arbitral disputes relating to pension and benefit design changes, in insolvency matters, and on the pension and benefits aspects of interest arbitrations.
