As pension counsel, we are often called upon to act on behalf of our clients in multi-stakeholder mediations where all parties share a common goal and seek an acceptable resolution with the assistance of a mediator. These mediated settlements – whether in a formal litigation proceeding or as part of a consent process – draw on both our advocacy and negotiation expertise and are particularly well suited to complex pension challenges.

We also defend employers and pension plan administrators in arbitration matters, including those involving pension disputes arising under collective agreements, as well as pension-related human rights discrimination claims before the Human Rights Tribunal of Ontario and the Canadian Human Rights Tribunal where it has been alleged that plan provisions discriminated on the basis of gender, disability and/or marital status.

Our lawyers have acted as counsel in class actions, civil pension negligent misrepresentation, pension loss and pension-related matrimonial litigation, in civil and arbitral disputes relating to pension and benefit design changes, insolvency matters, and on the pension and benefits aspects of interest arbitrations.

Most recently, we represented an employer in a surplus entitlement and distribution matter before the Financial Services Tribunal.
