Amendments to leave provisions of The Saskatchewan Employment Act now in effect

On January 1, 2026, amendments to the leave provisions of The Saskatchewan Employment Act came into force.

Key amendments include the following:

  • Serious illness and injury leave is extended to from 12 weeks to 27 weeks in a 52-week period,
  • Employees are exempted from certain leave eligibility requirements when their absence is due to a public health emergency,
  • Employees are eligible for a pregnancy loss leave if the loss occurs within 20 weeks prior to their estimated due date,
  • Employees are also entitled to a bereavement leave of 5 days if there is a death of a member of the employee’s immediate family or if there is a loss of pregnancy of the employee or of the employee’s immediate family member.

Under The Saskatchewan Employment Act, employers are generally required to continue to provide pension and benefits during a statutory leave of absence, provided that the employee pays their share of the contributions during the leave (if any).  However, more nuanced rules apply to certain leaves of absence.
