B.C. introduces Bill 43, which includes amendments to the Pension Benefits Standards Act

On November 1, 2023, the British Columbia government introduced Bill 43, the Money Judgment Enforcement Consequential Amendments and Transitional Provisions Act.

Bill 43 makes consequential amendments to various statutes in order to give effect to the Money Judgment Enforcement Act (Bill 47) which received Royal Assent on October 26, 2023. The Money Judgment Enforcement Act facilitates the enforcement of court orders that require debtors to pay sums of money to creditors.

Among the statutes amended by Bill 43 is the B.C. Pension Benefits Standards Act (PBSA).  Consequential amendments are made to the general prohibition against execution, seizure or attachment under the PBSA to allow a notice of seizure made under the Money Judgment Enforcement Act to enforce a maintenance order.
