Canada Labour Code amendments related to leaves of absence in force

On December 12, 2025, amendments to the Canada Labour Code with respect to certain leaves of absence came into force. 

The amendments to the Canada Labour Code include the following:

  • The introduction of a new pregnancy-loss leave of up to 8 weeks
  • Modifications to the existing bereavement leave to align treatment of a bereavement leave with other types of leave under the Canada Labour Code
  • The introduction of an enhanced bereavement leave for the death of a child
  • The introduction of a new leave for the placement of a child, which is not yet in force but will be proclaimed into force at the same time as related amendments to the Employment Insurance Act

Related amendments were also made to the regulations under the Canada Labour Code.

Under the Canada Labour Code, employers are generally required to continue to provide pension and benefits during a statutory leave of absence, provided that the employee pays their share of the contributions during the leave (if any).
