Canada Labour Code Officially Includes 10 Days Paid Sick Leave

As of December 1, the Canada Labour Code officially includes up to 10 days of paid sick leave per year for federally regulated employers.

The new leave provisions were added to the Code last year with the enabling regulations published in July of this year.

Under the new provisions:

  • Current employees will accrue 3 days paid sick leave as of December 31, 2022, while employees hired after December 1, 2022 will have access to their first three days of paid sick leave upon completing 30 days continuous employment. Thereafter employees gain 1 paid sick day per month to a maximum of 10 paid sick days in a year.
  • An employee can carry over unused days to the next year but those carried over days count towards that year’s maximum.
  • Employers will be able to request a medical certificate if an employee is absent for five days in a row or more.
  • The regulation also imposes new record-keeping obligations on employers relating to the paid sick leave.
