The Human Rights Tribunal of Ontario (“HRTO”) has denied a request for reconsideration of an earlier decision dismissing a human rights complaint against the Ontario Teachers' Pension Plan Board ("OTPPB").
The applicant initially filed an application alleging that OTPPB discriminated against him in its decision-making relating to his pension plan. The HRTO dismissed the application as it determined that the application was outside of the Tribunal’s jurisdiction as the events described in the application are not prohibited under the Ontario Human Rights Code. On reconsideration, the HRTO found again that the applicant had not established any connection between OTPPB's actions and a ground protected under the Human Rights Code.
