Newfoundland and Labrador's Bill 82, an Act to amend the Labour Standards Act, receives Royal Assent

On December 4, 2024, Newfoundland and Labrador Bill 82, An Act to amend The Labour Standards Act, received Royal Assent.

The Bill introduces the following amendments to the leave provisions of The Labour Standards Act:

  • Leave for long-term illness, long-term injury and organ donation: Bill 82 creates a new unpaid job-protected leave of up to 27 weeks in a 52-week period for employees who cannot work due to long-term illness, long-term injury or organ donation. To qualify, employees must have been continuously employed by the same employer for 30 days and require extended medical care or recovery time, as certified by a medical practitioner or a nurse practitioner.

  • Leave for long-term illness, long-term injury as a result of a criminal offence: the job-protected leave for long-term illness or long-term injury is extended to 104 weeks for employees whose injuries or illnesses result from a criminal offence.

  • Leave for reservists: Bill 82 also alters the existing job-protected leave for reservists. The updated legislation allows unpaid leave of up to 24 months within a 60-month period, with exceptions provided for national emergencies. The amendments also reduce the required notice of leave period from 60 days to 30 days.
