Ontario launches consultations on personal long-term illness leave under the Employment Standards Act, 2000

Ontario has launched consultations regarding a new personal long-term illness leave under the Employment Standards Act, 2000 (ESA).

Currently, employees have job protection under 14 different types of leaves, whether they work full-time, part-time, permanently, or on a contract basis. Despite this, Ontario is looking to strengthen job protection for employees living with serious illnesses.

The Ontario government is seeking feedback on two potential approaches:

  1.  Enhance the existing "critical illness" leave within the ESA to match the duration of EI sickness benefits.
  2.  Introduce a new leave category tailored for employees coping with a "severe medical condition," aligning its duration with EI sickness benefits. This approach might have a broader eligibility scope, extending to conditions or serious illnesses that aren't necessarily life-threatening.
