Prince Edward Island’s Bill 76 — the new Employment Standards Act (ESA) — received Royal Assent on November 29, 2024, replacing the existing version of the law. The ESA provides minimum employment standards related to the rights and obligations of employees and employers.

Following a comprehensive review over the last two years, the ESA Comprehensive Review Panel recommended that an entirely new act be drafted to replace the previous version of the ESA due to the large number of legislative amendments proposed.

The previous comprehensive ESA assessment was carried out in 2006.

The new ESA will come into force on a date to be fixed by proclamation of the Lieutenant Governor in Council. Until it is proclaimed in force, the current act with remain in effect.
